These Terms govern your use of Focen. By downloading, installing, or using the app, you agree to them. If you don’t agree, don’t use Focen.
1. Eligibility and age requirements
You must be at least 13 years old to use Focen. If you are between 13 and the age of majority in your jurisdiction (typically 18), you may only use Focen with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use.
Focen is not directed to children under 13, and such children may not use it. If we learn that a user is under 13, we will terminate the account and delete associated data. A parent, guardian, or school that installs Focen on a minor’s device represents that they have the authority and have obtained any consent required by applicable law (including COPPA and the GDPR), and accepts these Terms for that minor.
2. The service
Focen detects work sessions and helps you stay focused, including by blocking distracting browser tabs and enforcing breaks. Behavior may change as we improve the product. Focen is a productivity aid, not a medical, safety, or accessibility-of-last-resort device, and should not be relied on for any safety-critical purpose.
3. Subscriptions and refunds
The free tier requires no payment. You sign in with a Google or Apple account to use Focen. Each account includes one 7-day AI trial so you can try the paid features before paying. The trial is limited to one per account and one per device: a new account created on a device that has already used its trial will not receive another. AI is billed in advance monthly or annually. Because we offer a free trial, purchases are final and non-refundable except where required by law; see our Refund Policy for details. You can cancel a subscription anytime from the Lemon Squeezy customer portal at app.lemonsqueezy.com/my-orders, which is linked in the footer of this site and from Settings in the desktop app. Enter the email you paid with and Lemon Squeezy sends you a link to manage or cancel. Cancellation stops future charges and access continues until the end of the current period. We don’t offer partial refunds for unused subscription time beyond what the law requires. Prices for NEW subscribers may change over time; existing subscribers keep the price they signed up at for as long as their subscription stays active.
4. Acceptable use
- Don’t reverse engineer, resell, or redistribute the app except as allowed by law.
- Don’t use Focen to violate anyone’s rights or any law.
- Don’t attempt to disrupt or gain unauthorized access to our systems.
5. Intellectual property
Focen and its branding are owned by us. We grant you a personal, non-exclusive, non-transferable license to use the app under these Terms.
6. Disclaimer of warranties
Focen is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that it will block or close every distraction.
7. Limitation of liability
To the maximum extent permitted by law, Focen and its creator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or productivity, arising from or related to your use of (or inability to use) the app. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. Indemnification
You agree to indemnify and hold harmless Focen and its creator from claims arising out of your misuse of the app or your violation of these Terms or applicable law. For minors, the parent or guardian who consented under Section 1 provides this indemnity.
9. Dispute resolution and arbitration
Please contact us first at support@focen.app; most issues are resolved informally. If a dispute is not resolved within 30 days, you and Focen agree to resolve it through final, binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules rather than in court. The arbitration will be conducted remotely (by documents or video) unless the AAA rules require otherwise, and AAA consumer fee schedules apply. Either party may instead bring a claim in small-claims court, and you may opt out of arbitration entirely by emailing us within 30 days of first accepting these Terms.
Class-action waiver. Disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, to the extent permitted by law. Where a minor uses Focen, the consenting parent or guardian agrees to this section on the minor’s behalf.
10. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection law in your country of residence applies.
11. Changes and termination
We may update these Terms or discontinue features. Continued use after a change means you accept the updated Terms. We may suspend or terminate access for violations of these Terms.
